Terms of Service
These Terms of Service ("Terms") govern your access to and use of the website at automate-medical.com and the services provided by Automate AI, LLC ("Automate Medical," "we," "us," or "our"). By accessing or using the services, you agree to be bound by these Terms.
1. Use of the services
You may use the services only as permitted by these Terms and applicable law. You agree not to misuse the services, including by attempting to disrupt them, accessing them using methods other than the interface we provide, or attempting to reverse-engineer any part of the platform.
2. Accounts and access
Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.
3. Healthcare-specific terms
Not a substitute for medical advice. The Automate Medical platform provides decision support and is not a substitute for professional medical advice, diagnosis, or treatment. Clinicians remain responsible for all clinical decisions.
Business Associate Agreement (BAA). Use of the Automate Medical platform to process PHI requires a signed BAA. We will not process PHI without one in place.
No PHI on the public website. Do not submit PHI through the public contact form or any other non-secure channel. Use the secure customer portal or a BAA-covered channel.
4. Intellectual property
The services, including all content, software, and trademarks, are owned by Automate AI, LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of the services without our written permission.
5. Feedback
If you provide feedback or suggestions, we may use them without restriction or compensation.
6. Third-party services
The services may integrate with third-party platforms (Epic, Cerner, athena, Apple Health, Google Health Connect). Your use of those platforms is governed by their own terms.
7. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, AUTOMATE MEDICAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.
9. Indemnification
You agree to indemnify and hold harmless Automate Medical and its officers, directors, employees, and agents from any claim arising out of your breach of these Terms or your use of the services.
10. Termination
We may suspend or terminate your access to the services at any time for any reason, including breach of these Terms. Upon termination, your right to use the services ceases immediately.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws principles.
12. Changes to these Terms
We may update these Terms from time to time. The "last updated" date will reflect the most recent change. Material changes will be communicated via the platform or by email.
